What are the Charges?
You may have heard the phrase "assault and
battery." In civil law, an assault is the imminent
fear of touching (apprehension felt by the victim)
and the "battery" is the actual touching. In
criminal law, in Pennslyvania, assault and battery
are the same thing. You can be charged with
"assault" even if the victim never experienced
apprehension, if, for example, he was drunk and
never saw the punch coming during a bar fight.

Likewise, you can be charged with "assault" even
if you never touched the victim, so long as the
victim saw your take a swing and miss. We can
